Agreement and Operator

These Terms govern BlackBit’s website, AI inference gateway, cloud agent sandboxes, and related services (the Services). Your contracting party is orgn.dev, inc., a Delaware, United States corporation (we or us). BlackBit is the product name.

By accepting these Terms and using the Services, you agree to them. If acting for an organization, you represent that you have authority to bind it. Our Privacy Policy describes information handling.

Eligibility

You must be at least 18 years old and legally able to enter this agreement. Global access is subject to applicable law, sanctions, export restrictions, and payment-provider availability. You must not use the Services where prohibited.

The Services

We provide AI inference on our GPU fleet and cloud TDX encrypted sandboxes for agent tasks. Agents may run on your own machine or in a cloud sandbox. You select targets, instructions, agents, integrations, and permissions.

AI outputs may be inaccurate, incomplete, or unsafe to execute. Review outputs and control agent actions. We do not guarantee detection of vulnerabilities, compliance certification, or that actions will avoid disruption or remain within intended scope. Unrestricted model capabilities do not authorize unlawful use.

Authorized Security Testing Only

You may add targets only if you own them or have explicit written authorization to test them, such as a signed contract, an in-scope bug bounty program, or internal systems under your control. Authorization must cover the methods, systems, timing, and actions involved.

Unauthorized scanning, exploitation, or disruption of third-party systems is prohibited. You are responsible for scope, rules of engagement, and compliance with all applicable laws and contractual obligations. Stop when authorization expires, is withdrawn, or an action would exceed it.

You must not infringe others’ rights, gain unauthorized access, disrupt systems, or circumvent access restrictions or billing controls. You remain responsible for automated actions you instruct agents to perform.

API Keys and Lost Access

Keep your API key confidential and secure. Anyone with the key may be able to consume its credits. Do not put it in public repositories or support messages. We cannot recover a lost key or restore its balance to you. Store it securely before purchasing credits. Mandatory legal remedies remain unaffected.

Prepaid Credits and Payments

Payments purchase prepaid credits only. There are no subscriptions or automatic subscription renewals under these Terms. Applicable prices, currency, usage charges, and taxes are shown at purchase or in the applicable pricing information.

Each purchase of credits expires 90 days after its purchase date. Unused credits from that purchase expire at that time. Credits provide access to the Services; they are not a bank deposit or investment. Future price changes do not retroactively alter charges for completed usage.

Supported payment methods include cryptocurrency and Stripe. You must be authorized to use your payment method. Check cryptocurrency networks, destinations, amounts, and transaction fees before paying.

Refunds and Mandatory Consumer Rights

All unused credits are non-refundable, including expired credits and credits inaccessible because of a lost API key, except where applicable law requires a refund or other remedy.

Nothing here excludes mandatory consumer rights, including applicable withdrawal rights and remedies for non-conforming or unprovided services. Accepting these Terms alone does not waive a statutory withdrawal right. Where immediate performance requires a separate request, consent, or acknowledgment, it must be obtained through the relevant purchase flow.

Contact privacy@blackbit.sh about payment issues, identifying the relevant UUID or payment information without sending your full API key. Not storing a payer name does not remove a statutory entitlement.

Content and Outputs

You retain rights in your inputs. As between you and orgn.dev, inc., you may use outputs and we do not claim ownership of your content. This does not guarantee that outputs are unique, copyrightable, accurate, or free of third-party rights.

You grant us only the permissions needed to deliver requested Services, including transmission, computation, and temporary task storage. These permissions do not authorize model training, advertising, or resale of content. You must have the rights needed to submit inputs and use outputs.

Confidential Processing and Deletion

Inference requests are processed in memory without retained prompts, outputs, or content traces after processing. Cloud sandbox files, agent state, and disks are deleted after each task. These commitments do not apply to billing records, correspondence, or data held on your machine or by tools you select.

Save needed results before the task ends. BlackBit is not a backup or archive. Our Privacy Policy explains processing locations and information handling. Third-party tools and integrations are subject to their own terms, permissions, and data practices.

Our Intellectual Property

orgn.dev, inc. and its licensors retain their rights in the Services, software, branding, and documentation. You may use the Services for their intended purpose subject to these Terms. No ownership of our technology or permission to misuse our branding is granted. Applicable open-source licenses govern components distributed under those licenses.

Suspension and Termination

We may restrict or suspend access where reasonably necessary to address a breach, unlawful use, security threats, payment fraud, or legal requirements, without prior notice where urgency or law requires it. You may stop using the Services at any time.

Unused credits remain subject to the expiry and refund provisions and applicable law. Suspension does not remove mandatory consumer remedies. Provisions intended to survive, including payment obligations, intellectual property, liability, and disputes, continue to apply.

Disclaimers

To the maximum extent permitted by law, the Services are provided as is and as available, without warranties of uninterrupted availability, fitness for a particular purpose, accuracy, or error-free operation. Security testing and autonomous tools can cause disruption, data loss, and unintended effects even on authorized targets.

orgn.dev, inc. provides the tool and does not assume responsibility for your target selection, permissions, or operator conduct. These disclaimers do not override express contractual commitments or rights and liabilities that cannot lawfully be excluded.

Limitation of Liability

To the maximum extent permitted by law, orgn.dev, inc. is not liable for indirect or consequential losses, lost profits, or lost business arising from the Services. Subject to the exceptions below, aggregate liability is limited to the amount paid to orgn.dev, inc. for Services during the twelve months preceding the event giving rise to the claim.

Nothing excludes or limits liability for unlawful intent, gross negligence, or any other liability that cannot lawfully be excluded or limited. Mandatory consumer rights remain unaffected.

Operator Claims and Indemnity

To the maximum extent permitted by law, you release orgn.dev, inc. and its officers, employees, and contractors from claims arising from your target selection, unauthorized actions, or misuse, except to the extent attributable to their own breach or conduct for which liability cannot lawfully be excluded.

If using BlackBit in a business or professional capacity, you indemnify orgn.dev, inc. and its officers, employees, and contractors against third-party claims, damages, and reasonable legal expenses caused by your unlawful use, infringement of others’ rights, or breach of authorization requirements. This does not cover losses attributable to our own breach or conduct for which liability cannot lawfully be excluded.

orgn.dev, inc. will notify you of such claims and allow reasonable participation in the defense. No settlement may impose an admission or non-monetary obligation on you without consent. This indemnity does not bind third parties or prevent authorities from exercising their powers.

Swiss Law and Geneva Courts

Swiss substantive law governs these Terms. Subject to mandatory jurisdiction rules, the courts of Geneva, Switzerland have jurisdiction. If you are a consumer, this does not deprive you of mandatory protections or courts available under applicable law.

Changes and Contact

We may update these Terms for service or legal changes. We will publish revisions and provide advance notice of material changes where required. Changes do not retroactively remove accrued rights. Where new consent is required, publication alone is insufficient. If a provision is unenforceable, the remainder applies to the extent permitted by law.
